These Terms and Conditions (“Agreement”) apply to all gutter installation services (“Services”) provided by Precision Gutters, LLC (“Contractor”) to the customer (“Customer”) as outlined in the project estimate or invoice.

1. Scope of Work

Precision Gutters, LLC agrees to furnish all labor, materials, equipment, and supervision necessary to install gutters, downspouts, and accessories as detailed in the Customer's approved estimate. Any additional work or changes requested by the Customer must be approved in writing and may result in additional charges.

2. Materials

All materials supplied will be new, standard-grade, and suitable for gutter installation. Specific materials (e.g., aluminum, copper, color choice, size) will be listed in the estimate. Substitutions may occur only with Customer consent or in the event of product unavailability, with equal or higher-grade alternatives.

3. Payment Terms

A 35% deposit is required prior to scheduling work. No work will be scheduled until the deposit has been received and cleared.
The remaining 65% balance is due upon completion of the project unless otherwise agreed in writing.

Accepted forms of payment include:

Cash
Check
Money Order
ACH (Automated Clearing House Transfer)
Zelle
Credit Cards (subject to a 4% processing fee)

Returned checks will incur a $35.00 fee. Late balances may be subject to additional fees and collection actions. The Customer agrees to pay all costs associated with collection, including legal and administrative fees.

4. Scheduling and Access

Precision Gutters, LLC will make every effort to begin and complete the project in a timely manner, subject to weather, material availability, and unforeseen delays. The Customer must provide safe, unobstructed access to the installation site and agrees to remove vehicles, furniture, or other obstructions prior to the start date.

5. Site Conditions and Preparations

The Customer affirms that the structure and surfaces receiving gutter installation (e.g., fascia, roof edges) are in sound condition. If any damage, rot, mold, or structural issues are discovered, Precision Gutters, LLC will notify the Customer, and additional charges may apply for required repairs.

6. Liability

Precision Gutters, LLC is fully insured and uses standard industry practices during installation. However, we are not liable for:

Pre-existing damage to the property, structure, or roofing system
Hidden defects, insect infestation, or rot not visible during initial inspection
Damage resulting from existing poor construction or improper previous installations
Reasonable and incidental damage to the roof, shingles, or tiles during standard installation procedures

The Customer understands that minor roof disturbance may occur as part of the installation process. Precision Gutters, LLC will take all reasonable care to avoid and minimize such damage. Any damage beyond reasonable limits will be documented and discussed.

7. Warranty

Precision Gutters, LLC provides the following warranty for residential gutter installation:

Workmanship Warranty (Residential): A Limited Lifetime Warranty is provided to the original property owner on residential installations, covering defects in workmanship for the life of the gutter system under normal use and maintenance. This warranty is non-transferable.

This warranty does not cover:

Damage caused by acts of nature (storms, hail, wind, falling debris)
Improper maintenance, modifications, or tampering
Clogged gutters due to leaves, pests, or debris buildup
Roof damage or issues unrelated to gutter function
Detached or damaged gutters due to structural or fascia failure

All warranty claims must be submitted in writing with supporting photos or documentation. Precision Gutters, LLC reserves the right to inspect the issue before determining whether it falls under warranty.

8. Gutter Maintenance Responsibility

The Customer is solely responsible for the ongoing maintenance of installed gutter systems, including regular cleaning and inspection. Precision Gutters, LLC is not liable for damage resulting from clogged, obstructed, or neglected gutters.

9. Clean-Up and Debris Removal

All work areas will be cleaned and debris removed at the completion of the project. Precision Gutters, LLC is not responsible for disposing of personal or non-related items left in the work area.

10. Permits and Code Compliance

Unless otherwise specified, the Customer is responsible for securing any required permits or HOA approvals. All work will be performed in accordance with local building codes and standards.

11. Cancellation and Rescheduling Policy

Cancellations made less than 48 hours before the scheduled date may incur a fee of $150.00.
If materials have already been custom-ordered, deposits may be non-refundable.
Rescheduling must be requested in writing and is subject to availability.

12. Termination

Precision Gutters, LLC reserves the right to stop work or cancel the agreement for unsafe working conditions, lack of payment, or uncooperative behavior. Work completed up to that point will be billed accordingly.

13. Limitation of Liability

Under no circumstances shall Precision Gutters, LLC be liable for indirect, incidental, or consequential damages, including loss of property value or personal property damage unrelated to the installation. Maximum liability shall not exceed the total amount paid for the project.

14. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the State of Florida. Any legal disputes will be settled in a court of competent jurisdiction in Orange County, Florida.

15. Entire Agreement

This document constitutes the entire agreement between the Customer and Precision Gutters, LLC. No verbal agreements or statements shall be binding unless documented in writing and signed by both parties.
